Trial Preparation

Trial Preparation

Trial Preparation can entail many different aspects of claim handling. BPO works with attorneys to develop the needed evidence and facts required to establish a positive outcome to the case in litigation. Sometimes the investigation requires things such as reinspections of properties, file reviews, estimating services, mediation assistance, coverage opinions, subrogation investigations, accounting or financial evaluations, cause of loss opinions, and many other types of assistance. BPO has the experience and unique ability to view the whole picture and look “outside” of the box to assist with a litigated case. Our history with handling claims allows BPO the ability to successfully assist attorneys in a situation going to trial.
What Do Our Loss Adjusters Do?

The main work of a loss adjuster in trial preparation is gathering evidence and helping to develop the facts of what has taken place. In many court cases involving insurance companies, a loss adjuster is considered an expert witness to help not only with the trial preparation but also with testimony at trial. If an expert witness is not needed, then our experienced loss adjusters can assist behind the scenes and assist the attorneys with trial preparation.

Other duties of a loss adjuster during trial preparation include gathering the necessary evidence for the attorneys. The attorney can help with getting a subpoena for documentation if it is not willingly provided by the other side, however, the loss adjuster assists with analyzing the documentation so that the attorney can utilize the documentation and evidence for trial. Evidence may include reports submitted during the claim process, the events surrounding the claim and why it was filed, the validity of the claim, and interviews with the insured and any witnesses that were present for the loss being tried.

Why Loss Adjusters are needed with Trial Preparation and as Expert Witnesses

BPO’s professional loss adjusters can provide valuable resources and an experienced opinion regarding the claim handling process that can be very useful during trial preparation. The testimony of a highly trained and qualified loss adjuster is valuable to all parties because a well-documented case is hard to refute. The expert witness testimony of an experienced loss adjuster brings credibility to not only the attorney but also the case being tried.
